Article 2 – Definitions

Seller: Salt&Pepper.

Buyer (also referred to as the "Customer"): Any natural person who purchases or uses products or services offered by Salt&Pepper exclusively for non-professional purposes. The terms "Buyer" and "Customer" are used interchangeably throughout these Terms & Conditions.

Distance Contract: Any agreement between Salt&Pepper and the Buyer relating to goods or services concluded within the framework of an organised distance-selling system, using one or more means of distance communication up to and including the moment the agreement is concluded.

Products: Any products offered by Salt&Pepper on the Website, including home décor, tableware and similar products.

Website: The Seller's website, accessible via www.saltandpeppershop.eu.

Means of Distance Communication: Any method that enables the conclusion of an agreement between Salt&Pepper and the Buyer without both parties being physically present at the same time.

Article 3 – Scope

These Terms & Conditions apply to every offer made by Salt&Pepper as an online retailer to the Buyer, being any natural person purchasing or using the offered products or services exclusively for non-professional purposes.

To place an order, you must be at least 18 years old. If you are under the age of 18, your order must be placed by your parent or legal guardian. If Salt&Pepper becomes aware that an order has been placed by a minor, it reserves the right to refuse that order.

If specific terms and conditions apply in addition to these Terms & Conditions and any conflict exists between them, the specific terms shall prevail unless otherwise stated.

Any deviation from these Terms & Conditions shall only be valid if expressly agreed in writing. All remaining provisions shall remain fully applicable.

These Terms & Conditions apply to all Buyers unless otherwise agreed in writing by Salt&Pepper.

Salt&Pepper reserves the right to amend or supplement these Terms & Conditions at any time in relation to future orders.

By using the Website and/or placing an order, the Buyer accepts these Terms & Conditions together with all other rights and obligations published on the Website.

If one or more provisions of these Terms & Conditions are found to be unlawful, invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions. Such provision shall be deemed severable from the remaining Terms & Conditions.

These Terms & Conditions constitute the entire agreement between the Buyer and Salt&Pepper regarding the matters covered herein.

Article 4 – Offers and Conclusion of the Agreement

Offers remain valid while they are displayed on the Website and subject to stock availability. Where specific conditions apply to an offer, these will be clearly stated.

Salt&Pepper strives to describe the Products offered and the ordering process as accurately and completely as possible. Product descriptions include all essential information to enable the Buyer to make an informed purchase.

Where images are used, they provide a true representation of the Products offered. However, minor errors or inaccuracies may occur. Obvious mistakes or errors shall not be binding on Salt&Pepper.

The agreement is concluded and becomes binding once the order confirmation has been provided to the Buyer or sent to the email address supplied by the Buyer, and once payment by credit or debit card has been authorised by the relevant card issuer.

If the card issuer refuses to authorise payment, Salt&Pepper cannot be held responsible for delays or failure to deliver the order. Orders without valid payment authorisation will not be accepted or processed.

Article 5 – Orders

To purchase a Product online, the Buyer must first add the desired Product to the shopping basket, complete the requested contact and billing details, and then select the preferred delivery method.

In the final step, the Buyer is presented with an overview of the order. The Buyer must accept these Terms & Conditions and confirm the payment by clicking the button labelled "Place order with obligation to pay". Once these steps have been completed, the order becomes binding.

Article 6 – Prices

For consumers within the European Union, all prices are stated in euros and include VAT and any other taxes or charges required by law.

For deliveries outside the European Union, import duties, customs charges or local taxes may apply where permitted by applicable legislation. Where applicable, the Buyer will be informed before the agreement is concluded. Payments are processed in the currency in which the order is placed.

The applicable price is the one shown during the final step of the ordering process and confirmed in the order confirmation sent by Salt&Pepper.

Salt&Pepper reserves the right to correct obvious pricing or discount errors and, where necessary, to cancel the relevant order.

Delivery charges and, where applicable, return costs are clearly communicated before the agreement is concluded.

Certain payment methods may be subject to additional conditions relating to delivery or administrative charges. Any such conditions will be communicated before the order is completed.

Article 7 – Payment

The following payment methods are available for purchases made through the Website: iDEAL, Bancontact, PayPal, Belfius Pay Button, KBC/CBC Pay Button, Sofort Banking, Bank Transfer, ING Home'Pay, Visa and Mastercard.

Salt&Pepper reserves the right to expand the available payment methods at any time. Any new payment methods will be announced on the Website.

Where payment is made by credit card, the terms and conditions of the relevant card issuer shall apply. Salt&Pepper is not a party to the agreement between the Buyer and the card issuer.

To protect payment and personal data, all online transactions are secured using SSL encryption. No additional software is required. A secure connection can be recognised by the padlock symbol displayed in your browser.

The following conditions apply to the use of promotional discount codes:

• Unless stated otherwise, each discount code may only be used once.
• Any attempt at fraud, misuse or any other unauthorised use will render the discount code invalid.

Article 8 – Delivery and Delivery Conditions

Orders are processed and dispatched as quickly as possible. Salt&Pepper aims to deliver orders within 3 to 7 working days after the order has been confirmed.

If an ordered Product is temporarily out of stock, the Buyer will be informed of the expected delivery date. In the event of a delay, Salt&Pepper will endeavour to notify the Buyer by email within three working days.

If Salt&Pepper is unable to meet the estimated delivery period, the Buyer will be informed before the original delivery period expires. If no such notification is provided, the Buyer is entitled to cancel the order free of charge. In that case, Salt&Pepper will refund any amounts already paid as soon as possible and no later than 14 days after the cancellation.

Salt&Pepper bears the risk of loss or damage until the Products have been delivered to the Buyer. If Products are lost or damaged during transport before delivery, the Buyer bears no responsibility. In the event of a return shipment, however, the transport risk remains with the Buyer.

Risk passes to the Buyer upon delivery of the Products to the specified delivery address. The Buyer or a person designated by the Buyer must be available to accept the delivery. If delivery cannot be completed, a new delivery attempt may be arranged.

Salt&Pepper cannot be held liable for unsuccessful deliveries if:

• the Buyer has provided an incorrect or outdated delivery address;
• no one is available to receive the delivery at the specified address;
• the Buyer fails to provide a new or corrected delivery address within 24 hours after being contacted.

Without prejudice to the statutory warranty provisions and except in cases of wilful misconduct, gross negligence, or liability for death or personal injury, Salt&Pepper's total liability shall be limited to the purchase price of the Products concerned.

Article 9 – Right of Withdrawal

The Buyer has the right to withdraw from the agreement within 14 days of receiving the Products, without giving any reason.

The Products must be returned in their original condition. Once the returned Products have been received and inspected, Salt&Pepper will refund the purchase price within 14 days.

A fixed return fee of €10 applies to all returns. This fee is clearly communicated before the agreement is concluded.

Salt&Pepper reserves the right to withhold reimbursement until the returned Products have been received or until the Buyer has provided proof that the Products have been returned, whichever occurs first.

During the withdrawal period, the Buyer must handle the Products and their packaging with due care. The Products may only be unpacked or used to the extent necessary to establish their nature, characteristics and functioning. Products that have been used cannot be returned.

Salt&Pepper reserves the right to charge for any loss in value if returned Products are damaged, used, soiled, or returned without their original packaging or labels. Returns must include all supplied accessories and the original packaging.

To exercise the right of withdrawal, the Buyer must register the return through the Salt&Pepper returns portal. The return procedure is explained in the FAQ section of the Website. After registration, the Buyer will receive confirmation of the return request.

Salt&Pepper does not make exceptions to the above conditions relating to the right of withdrawal.

Article 10 – Retention of Title

Ownership of the delivered Products shall only pass to the Buyer once the full purchase price, including any interest and costs due, has been paid in full, even if the Products have already been delivered.

Until ownership has transferred, the Buyer may not pledge, sell, transfer or otherwise encumber the Products.

Article 11 – Conformity and Warranty

Salt&Pepper guarantees that the Products supplied conform to the agreement and meet the reasonable expectations of the Buyer, taking into account the Product specifications and description provided for each Product.

Furthermore, Salt&Pepper guarantees that its Products comply with the legal requirements applicable at the time the order is placed.

Consumers are entitled to the statutory 2-year warranty on Products purchased from Salt&Pepper. Within this period, Salt&Pepper will repair or replace, free of charge, any Product that proves to be defective under the statutory warranty, provided the Buyer can demonstrate that the defect was not caused by improper or abnormal use.

To make a warranty claim, the Buyer must be able to present proof of purchase or an invoice. These documents should therefore be retained carefully. Warranty rights are personal to the Buyer and cannot be transferred.

Any defect must be reported within 2 months of being discovered. After this period, the right to repair or replacement will lapse.

The warranty does not cover defects or damage resulting from:

• accidents;
• damage aggravated by negligence;
• dropping or impact;
• use other than the intended purpose;
• failure to follow the care or usage instructions;
• excessive, improper, commercial or abusive use.

Article 12 – Force Majeure

Salt&Pepper shall not be liable for any failure to perform its obligations where such failure results from an event of force majeure. In such circumstances, Salt&Pepper may suspend the performance of its obligations for the duration of the force majeure event or terminate the agreement, in whole or in part.

Force majeure includes any circumstance beyond the reasonable control of Salt&Pepper that prevents the fulfilment of its obligations, whether temporarily or permanently. This includes, but is not limited to, strikes, fire, disruptions to (telecommunication) networks or connections, failures of communication systems, the unavailability of the Website, and delays or non-performance by suppliers or other third parties.

Article 13 – Intellectual Property

The Buyer expressly acknowledges that all intellectual property rights relating to the information, communications, Products and other content displayed on the Website are owned by Salt&Pepper, its suppliers or other rights holders.

These rights include, but are not limited to, copyrights, trademarks, patents, design rights and all other intellectual property rights, including technical and commercial know-how.

The Buyer may not reproduce, modify, distribute or otherwise use any intellectual property rights without the prior written consent of Salt&Pepper or the relevant rights holder, except where strictly necessary for the normal private use of the purchased Product.

Article 14 – Personal Data and Cookies

For information regarding the processing of personal data and the use of cookies and similar technologies, Salt&Pepper refers to its Privacy Policy and Cookie Policy. These documents are available on the Website and form an integral part of the agreement between Salt&Pepper and the Buyer.

By using the Website and/or placing an order, the Buyer also accepts the Privacy Policy and Cookie Policy.

Article 15 – Complaints Procedure

Salt&Pepper values customer satisfaction. If the Buyer has a complaint regarding a Product or service, they may contact Salt&Pepper's customer service department at any time.

We aim to handle every complaint as quickly as possible. In most cases, you will receive a response within 14 days. After carefully reviewing your complaint, we will contact you again to discuss an appropriate solution.

Article 16 – Governing Law and Jurisdiction

All offers and agreements concluded with Salt&Pepper shall be governed exclusively by Belgian law.

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

Any disputes arising out of or in connection with offers or agreements concluded with Salt&Pepper shall fall within the exclusive jurisdiction of the competent courts of Antwerp, unless mandatory law provides otherwise.

Article 17 – Promotional Sales and Campaigns

During promotional campaigns and sales periods, the price shown in the order summary at the moment the order is completed shall always apply.

All discounts apply only to the specified Products, during the stated promotional period and while stocks last.
